SUB.. MINOR LAPSES IN E-SUGAM OR M-SUGAM

DATED..29.11.13 TO, SRI AJAY JI SETH HON'BLE COMMISSIONER, COMMERCIAL TAXES DEPARTMENT, GANDHI NAGAR,BANGALORE KARNATAKA SUB.. MINOR LAPSES IN E-SUGAM OR M-SUGAM RESPECTED SIR, Season's greetings from the members of Karnataka Hosiery and Garments Association.. This has reference to the implementation of E-Sugam on various commodities (specifically Ready -Made Garments) with effect from November 1, 2013. Further, we refer to your circular as per which the ‘educative period’ has been extended to November 30, 2012. At the outset, we thank you and appreciate the extension given to the ‘educative period’. This was a much required extension for the Trade and Industry. You may appreciate that, we at our end have already initiated specific measure to prepare the dealers for a smooth implementation of E-Sugam. Necessary training is also being given and the dealers are being educated on the approach to comply with the E-Sugam procedure. We also thank you for the training extended by the Commercial Tax Office to the dealers in understanding the nuances of the E-Sugam Procedure. Sir, we request you to please adopt a lenient view till the dealers are completely able to understand the E-Sugam ,Procedure. Imposition of penalties on each and every default may hinder the relationship between the dealers and the commercial tax office. With the implementation of E-Sugam, each and every dealer is now expected to comply with the statutory norms and ensure that accountability is afforded for every transaction relating to purchase, sale and every other movement of goods. This is also further enable the dealers to remit the applicable taxes to the account of the Revenue and consequentially will result in deposit of all applicable dues under the local VAT law. We believe that this measure would help to bridge the complete gap between the Trade and the Commercial Tax Office and also lead to compliance with law as a whole. If the lenient view is taken and minor lapses are ignored, then the Traders and Dealers may be benefited as they make their progress to ensure all compliance. Therefore, it is a humble and sincere request that the commercial tax department may be instructed to ignore small procedural lapses as long the accountability to goods is completely given. If you feel so, then this lenient view may be issued to the check posts and other concerned tax offices. This final step may help the dealers with unnecessary penalties on minor lapses. Your good -self may appreciate that Revenue would surely increase as the accountability and compliance with goods is also going to increase. But levy of penalty on minor lapses may not increase the revenue but could unnecessarily hinder the compliance which has now moved a step ahead by way of E-Sugam Implementation. VIEWS EXPRESSED BY MANY LEADING CHARTERED ACCOUNTANTS ON E-SUGAM

We sincerely request for your intervention on this matter and help the Trade for which E-Sugam implementation in the middle of the year is also impossible. The Tax Department has been unaware of the fact that the business of Readymade Garments and Hosiery is a seasonal business and hence, E-Sugam cannot be implemented in the middle of a Season. Introduction of E-sugam will be like taking away the part of living which a small trader is making to pay to the consultant or to buy a computer and have internet connection just to issue E-sugam. A cost of thirty thousand plus for a computer and a minimum cost of Rs.250/- per month for internet connection will affect a small dealer very dearly. Also considering the fact that the dealer are less educated about the computer, the department should provide them a little more time to get accommodated to the new system and procedure. Sir, the Garment and Hosiery Industry is a season specific industry as you are aware and E-Sugam implementation in the middle of this Winter Season has left various dealers stranded and under the grip of huge tension. If the E-Sugam implementation is not extended, this could result in a damage much beyond what we can comprehend. It would be highly appreciative if this implementation is postponed till April 2014. I have witnessed the dealers who are yet to be educated on generation of E-Sugam and I really feel that a sudden implementation of E-Sugam would result in miscarriage of natural justice. I have seen genuine dealers paying very high to the consultants for generating each E-Sugam. Sir, we are with you. We thank you for your efforts being put in. Sir, please help the entire trade and industry by getting this extension of E-Sugam implementation. This would be a blessing to the entire Trade and Industry. I pray that God would intervene in this matter and help out the sincere and genuine dealers who are faced with the task of clearing this huge stock of seasonal goods in such a short period of time on account of E-Sugam Implementation. VIEWS ABOUT E-SUGAM IN KARNATAKA OF CAIT GENERAL SECRETARY

No.: 1424/1/29 25th November, 2013 Shri Siddaramaiah, Hon'ble Chief Minister & Finance Minister, Government of Karnataka, Bangalore Dear Shri Siddaramaiah Ji, CAIT would like to bring in your attention about the practical difficulties faced by traders ever since introduction trader unfriendly ‘e-sugam’. We believe the policy was devised with all good intentions and encourage transparent and fair trade in state. However in reality it is proving counter productive as this will encourage traders to exploit system and prefer to do business without keeping proper records. This will also promote nexus between inspectors, other enforcement officials and traders. Instead of revenue coming to government exchequer, the money will go in the pocket of few officials. Such a situation will be detrimental to economy and development of state. The conditions of e-sugam are very impractical due to following reasons:- 1. It directs to register the trader to his consignment invoice and receives a number for any transaction where the value of the goods is equal to or more than Rs 20,000. 2. First problem is that most of the traders are single handedly handling their trading activities, hence as per the notification, he/she needs to spend considerable time in registering and generating consignment number from the e-sugam web portal or through mobile. 3. Our main submission is that around 90% of traders are still not computer literate. Hence what is the use of imposing a rule where the user is not up to the mark. 4. Even those traders who are computer literate may not have necessarily a computer with internet facility in their work premises. 5. Generating e-sugam number may also not be always feasible as this too will consume time and in hinterland and countryside the user may fequenty face the network coverage issue. 6. In very short, the submission is that this notification if implemented will create a headache for honest trader who will have to focus more on compliance process and requirements rather than his trading activity. Thus it will be adversely affect trading environment in state. Another biggest challenge which state must look into is the clear violation by those traders who knows to exploit the situation. There will be many unscrupulous individuals who will use the existing rules of e-sugam for their business benefit without paying any taxes at all. Example there is provision of cancellation of e-sugam citing various reasons. As per the current notification, the number obtained needs to be produced at the department’s checkpost or shown to officials randomly inspecting vehicles transporting goods. The unscrupulous traders after ensuring that the consignment reached the destination cancel the transaction filed under e-Sugam. Thus this mechanism fails to deter the dishonest traders have been using the duration of delivery of goods for evasion purposes. Sources in the Commercial Tax Department said a dealer can cancel the consignment invoice without drawing the attention of the department as its validity is for 48 hours. In such scenario I would like you to kindly have a re-look at the fair objectives and deliverables of the e-sugam so that it encourages honest traders, increases state revenue while curbing the menace of tax evasion and corrupt nexus of tax officials. खागा सदस्यो के लिए इ -सुगम प्रशिक्षण शिविर का आयोजन

कर्नाटक होजरी एंड गारमेंट assn की तरफ से fkcci सभागार में बुधवार देर शाम तक मुख्य अतिथि अतिरिक्त आयुक्त,वाणिज्य कर विभाग (commercial taxes ) श्री मानवी जी के सानिध्य में तथा श्री बी टी मनोहर , संयोजक,राज्य कर समिति के आतिथ्य में खागा के सदस्यो के लिए इ -सुगम प्रशिक्षण शिविर का आयोजन किया गया। अध्यक्ष मनोज गर्ग ने स्वागत किया तथा इसे फिलहाल ना लागू करने कि विनती की तथा मंत्री गौतम ​​पोरवाल ​ने खागा कि गतिविधिओ से अवगत कराया । उन्होंने इ-सुगम के बारे में अब तक के प्रयासो के बारे में जानकारी दी। मुख्य अतिथि श्री मानवी ने खागा के कार्यो कि सराहना कि तथा इ-सुगम के बारे में विस्तृत जानकारी दी और विशवास व्यक्त किया कि समस्त व्यापारी वर्ग का समर्थन रहेगा। श्री मानवी ने बताया कि किसी भी विशेष परिस्थिति में आप उनसे संपर्क कर अपनी जायज समस्या का हल प्राप्त कर सकते है। सहायक आयुक्त श्री बिरादर तथा श्री तिप्पे स्वामी जी ने विडिओ प्रस्तुति दी तथा इसे सुगमता से कैसे अपना सकते है , अपनी जिवंत प्रस्तुतु दी। श्री बी टी मनोहर ने आज के दौर में इसकी अहमियत और प्रासंगिकता पर जोर दिया पर साथ ही विभाग से इसे सुगमता से निर्विध्न रूप से जारी करने की पुरजोर अपील की । संचालक एवं खागा कराधान समिति के संयोजक सज्जन राज मेहता ने व्यापारिओं से प्राप्त प्रश्नो कि बौछार को एक एक कर उनके सम्मुख रखा और समाधान प्राप्त करने कि चेष्टा की। उन्होंने इसे इ-दुर्गम की संज्ञा दी। उपस्थित सैंकड़ो व्यापारिओं ने अपनी जिज्ञासा का समाधान लेने में भरपूर दिलचस्पी दिखाई तथा कार्यक्रम करीब ४ घंटे चला। कार्यक्रम में उपस्थित अध्यक्ष शिव कुमार ,fkcci तथा सम्पत् रमन,उपाध्यक्ष fkcci ने भी अपने विचार रखे। सभी अतिथिओं का सम्मान खागा के पदाधिकारी उपाध्यक्ष दिलीप जैन,डूंगर मल चोपड़ा, सह मंत्री कैलाश बॉलर ,अमर सिंह तथा कोषाध्यक्ष सुभाष भंसाली और अध्यक्ष मंत्री ने किया। पूर्व अध्यक्ष पहाड़ सिंह राजपुरोहित ने धन्यवाद ज्ञापित किया । सधन्यवाद वास्ते खागा गौतम पोरवाल मंत्री 9844015271​

This can only be effected if the number of vehicles on roads are reduced. n Effective environmental infrastructure to address the issues of untreated sewage and waste polluting rivers, lakes and coastal zones, (thus threatening water ecosystems). n Empowerment of women and encouraging their participation in the political, social and economic life of a city and adoption of urban policies that take into account women’s needs and initiatives. n Development of an efficient urban private sector, both formal and non-formal which reduces poverty by generating jobs and helping in economic growth. n An efficient health-care system which would also address issues of nutrition, family planning and sanitation. n A mechanism in the form of a policy initiative for industrial dispersal to satellite townships where better employment opportunities are created.
